In his latest move to clamp down on illegal immigration and immigration more broadly, President Trump has filed a presidential action invoking the Alien Enemies Act of 1798, a seldom-used law that gives the president authority to detain or deport nationals of an enemy nation during wartime. It’s only the fourth time in American history a president has used the act — and the first since World War II.

      We know. We never got rid of the electoral college, but we tried. It was only a matter of time, sadly. The fall of techno Rome has long been harkened. Land shouldn’t vote; people should.

      Luckily it was stopped almost immediately, for now at least. We aren’t at war so this is not legal. Does the executive listen to the courts though? I think we’ll soon see.

        ICE is doing arrests on suspicion of immigration status. This act allows deportation without trial or hearing. Combine the two, and anyone can be ‘legally’ disappeared with no trial.

    Not sure if NPR changed it but the headline linked says “Federal judge blocks Trump’s plan to target ‘alien enemies’ for deportation”.

    The article goes on to say that a federal judge has temporarily blocked President Trump’s use of the Alien Enemies Act to deport Venezuelan citizens linked to the gang Tren de Aragua.

    The judge blocked Trump’s action hours after it was enacted “stopping the administration from using it to deport anyone, adding that the administration should turn planes already in the air around.”

        Then the answer is no. That’s what being a nation of laws means. Doesn’t matter if Congress has abdicated their duties. No formal declaration of war, no new powers.

        Now likely what you mean is that we’ve left the notion that we are a nation of laws, then yes. Laws have stopped having any kind of meaning for the President.

        This law requires them to be sanctioned by Congress. It can’t just be a “special military operation” like Iraq was.

          That requires the rest of the government, namely Congress to stop the President from directing his branch of government break the law. And they’ve shown no intention of starting to do that.

            The courts have put a pause on this for now at least. They don’t have a mechanism of enforcement though, so theoretically Trump can just ignore them. We’ll have to wait and see what they do I guess. Hopefully they aren’t willing to directly contradict the courts yet.

      Why? What is any of that going to do? Unless your passport is packing and willing to die for you. All those things can disappear just like Mahmoud Khalil.

      Police will ask you, “do you have a passport?” You hand passport to them. Police respond with “I didn’t see a passport, guess you are disappearing now.” That’s literally how that interaction will play out. We are pass legal documents having any kind of meaning.
