Laut einem Gesetzestext, der dem STANDARD vorliegt, soll künftig die Überwachung von Nachrichten möglich sein, “die verschlüsselt gesendet, übermittelt oder empfangen werden”, und zwar “durch Einbringen eines Programms in ein Computersystem des Betroffenen”.

So wie ich das verstehe, muss der neue Bundestrojaner also eine genaue Liste haben, damit nur bestimmte Chats überwacht werden und nicht alle Chats der Person, damit keine Nachrichten unschuldiger Personen betroffen sind.

Im Jahr 2019 hat der Verfassungsgerichtshof (VfGH) den damals geplanten Bundestrojaner wegen “schwerwiegender Eingriffe in die Privatsphäre” als unzulässig beurteilt und gekippt. Das damalige Konzept habe – vereinfacht gesagt – eine zu große “Streubreite” gehabt. Da Handys oder Laptops zur Gänze überwacht worden wären, hätten die Behörden Rückschlüsse auf den höchst privaten Lebensbereich ziehen können. Zudem hätte der Bundestrojaner damit “eine Vielzahl an auch unbeteiligten Personen” betreffen können.

Technisch ergibt das für mich immer noch wenig Sinn (wie kann man bei einem aktuellen Gerät einen Trojaner auf eine Art und weise installieren, sodass nur bestimmte Chats betroffen sind). Aber ich bin froh, dass zumindest keine Massenüberwachung am Regierungsprogramm steht.

Nur zur Klarstellung: es geht um die Auswertung der Chats bei beschlagnahmten Geräten:
